Art. 43a Bed load budget

1 The bed load budget in the body of water may not be changed by installations to the extent that they cause serious harm to the indigenous flora and fauna, their habitats, the groundwater regimen and flood protection. The persons responsible for the installations shall take suitable measures to this end.

2 The measures are determined by:

a.
the degree of harm caused to the body of water;
b.
the ecological potential of the body of water;
c.
the proportionality of the cost;
d.
the interests of flood protection;
e.
the energy policy goals relating to the promotion of renewable energy sources.

3 Within the catchment area of the body of water concerned, the measures must be coordinated with each other after hearing the persons responsible for the installations concerned.

Art. 43a Régime de charriage

1 Le régime de charriage d’un cours d’eau ne doit pas être modifié par des installations au point de porter gravement atteinte à la faune et à la flore indigènes et à leurs biotopes, au régime des eaux souterraines et à la protection contre les crues. Les détenteurs de ces installations prennent les mesures nécessaires.

2 Les mesures sont définies en fonction des facteurs suivants:

a.
gravité des atteintes portées au cours d’eau;
b.
potentiel écologique du cours d’eau;
c.
proportionnalité des coûts;
d.
protection contre les crues;
e.
objectifs de politique énergétique en matière de promotion des énergies renouvelables.

3 Dans le bassin versant du cours d’eau concerné, les mesures doivent être coordonnées après consultation des détenteurs des installations concernées.
