Art. 91 Decision on the request

1 The Federal Office shall decide on whether to accept the foreign request after consulting the prosecuting authorities.

2 If it accepts the request, it shall transmit the file to the prosecuting authority and notify the requesting State and the person concerned.

3 The decision does not create an obligation to institute criminal proceedings.

4 The Federal Office may refuse to assume responsibility for the prosecution if there is good cause not to do so or if the seriousness of the offence does not justify it.

Art. 91 Décision sur la demande

1 L’office fédéral, après avoir conféré avec l’autorité de poursuite pénale, statue sur l’acceptation de la demande étrangère.

2 Dans l’affirmative, il transmet le dossier à l’autorité de poursuite pénale et en informe l’État requérant, ainsi que l’intéressé.

3 La décision n’oblige pas à ouvrir une action pénale.

4 L’office fédéral peut refuser la poursuite pénale, si des raisons majeures s’y opposent ou que l’importance de l’infraction ne la justifie pas.
