Art. 325ter Infringement of other reporting obligations

1 A person shall be liable to a fine not exceeding 100 000 francs if he or she wilfully commits any of the following acts:

a.
provides false information in the reports in accordance with Articles 964a, 964b and 964l CO415 or fails to make the required reports;
b.
fails to comply with the statutory obligation to retain and document the reports in accordance with Articles 964c and 964l CO.

2 A person who acts through negligence shall be liable to a fine not exceeding 50 000 francs.

Art. 325ter Inobservation des prescriptions relatives à l’établissement d’autres rapports

1 Est puni d’une amende de 100 000 francs au plus quiconque, intentionnellement:

a.
donne de fausses indications dans les rapports visés aux art. 964a, 964b et 964l CO420 ou omet d’établir ces rapports;
b.
contrevient à l’obligation de conservation et de documentation des rapports visée aux art. 964c et 964l CO.

2 Quiconque agit par négligence est puni d’une amende de 50 000 francs au plus.
