Art. 303 False accusation

1.  Any person who makes an accusation to the authorities that a person whom he knows to be innocent has committed a felony or a misdemeanour, with the intention of causing a criminal prosecution to be brought against that person,

any person who otherwise carries out malicious acts with the intention of causing a criminal prosecution to be brought against a person whom he knows to be innocent,

shall be liable to a custodial sentence or to a monetary penalty.

2.  If the false accusation relates to a contravention, the penalty is a custodial sentence not exceeding three years or a monetary penalty.

Art. 303 Dénonciation calomnieuse

1.  Celui qui aura dénoncé à l’autorité, comme auteur d’un crime ou d’un délit, une personne qu’il savait innocente, en vue de faire ouvrir contre elle une poursuite pénale,

celui qui, de toute autre manière, aura ourdi des machinations astucieuses en vue de provoquer l’ouverture d’une poursuite pénale contre une personne qu’il savait innocente,

sera puni d’une peine privative de liberté ou d’une peine pécuniaire.

2.  La peine sera une peine privative de liberté de trois ans au plus ou une peine pécuniaire si la dénonciation calomnieuse a trait à une contravention.
