Art. 301 Military espionage against a foreign state

1.  Any person who conducts or organises the conduct of military intelligence gathering services on Swiss territory for a foreign state against another foreign state, and

any person who recruits persons for or facilitates such services,

shall be liable to a custodial sentence not exceeding three years or to a monetary penalty.

2.  Any correspondence and other materials are forfeited.

Art. 301 Espionnage militaire au préjudice d’un État étranger

1.  Celui qui, sur territoire suisse, aura recueilli des renseignements militaires pour un État étranger au préjudice d’un autre État étranger ou aura organisé un tel service,

celui qui aura engagé autrui dans un tel service ou favorisé de tels agissements,

sera puni d’une peine privative de liberté de trois ans au plus ou d’une peine pécuniaire.

2.  La correspondance et le matériel seront confisqués.
