Art. 276 Incitement and inducement to violate military duties

1.  Any person who publicly incites others to disobey military orders, to violate military duties, to refuse to perform military service or to desert, and

any person who induces a person obliged to perform military service to carry out such an act,

shall be liable to a custodial sentence not exceeding three years or to a monetary penalty.

2.  Where the incitement or inducement relates to mutiny or the preparation for mutiny, the penalty is a custodial sentence or a monetary penalty.

Art. 276 Provocation et incitation à la violation des devoirs militaires

1.  Celui qui aura publiquement provoqué à la désobéissance à un ordre militaire, à une violation des devoirs de service, au refus de servir ou à la désertion,

celui qui aura incité une personne astreinte au service à commettre une de ces infractions,

sera puni d’une peine privative de liberté de trois ans au plus ou d’une peine pécuniaire.

2.  La peine sera une peine privative de liberté ou une peine pécuniaire si le délinquant a provoqué ou incité à la mutinerie ou au complot.
