Art. 26

Foreign authorities have jurisdiction:

a.: if jurisdiction derives from a provision of this Act or, in the absence of such a provision, if the defendant was domiciled in the state in which the decision was rendered;
b.: if, in matters involving an economic interest, the parties submitted to the jurisdiction of the authority that rendered the decision by means of an agreement valid under this Act;
c.: if, in matters involving an economic interest, the defendant proceeded on the merits without reservation;
d.: if, in the case of a counterclaim, the authority that rendered the decision had jurisdiction to hear the main claim and if there is a factual connection between the claim and counterclaim.

Art. 26

La compétence des autorités étrangères est donnée:

a.: si elle résulte d’une disposition de la présente loi ou, à défaut d’une telle disposition, si le défendeur était domicilié dans l’État dans lequel la décision a été rendue;
b.: si, en matière patrimoniale, les parties se sont soumises par une convention valable selon la présente loi à la compétence de l’autorité qui a rendu la décision;
c.: si, en matière patrimoniale, le défendeur a procédé au fond sans faire de réserve, ou
d.: si, en cas de demande reconventionnelle, l’autorité qui a rendu la décision était compétente pour connaître de la demande principale et s’il y a connexité entre les deux demandes.
