1 Contracts pertaining to intellectual property are governed by the law of the state in which the transferor or licensor of the intellectual property right has their habitual residence.
2 A choice of law is allowed.
3 Contracts concluded between an employer and an employee concerning rights to intellectual property created by the employee in the course of performing their work are governed by the law applicable to the employment contract.
1 Les contrats portant sur la propriété intellectuelle sont régis par le droit de l’État dans lequel celui qui transfert ou concède le droit de propriété intellectuelle a sa résidence habituelle.
2 L’élection de droit est admise.
3 Les contrats passés entre un employeur et un travailleur, qui concernent des droits de propriété intellectuelle sur des inventions que le travailleur a réalisées dans le cadre de l’accomplissement de son travail, sont régis par le droit applicable au contrat de travail.
