Art. 27

1 Where a ground for nullity applies to only a part of the patented invention, the court shall limit the patent accordingly.

2 The court shall give the parties an opportunity to be heard on the proposed new version of the patent claim; it may also request the opinion of the IPI.

3 Article 25 applies by analogy.

Art. 27

1 Lorsque seule une partie de l’invention brevetée est entachée de nullité, le juge limitera le brevet en conséquence.

2 Il donnera aux parties l’occasion de se prononcer sur la rédaction nouvelle qu’il entend donner à la revendication; il pourra en outre demander l’avis de l’IPI.

3 L’art. 25 est applicable par analogie.
