Art. 39b Safeguarding of manufacturing and trade secrets

1 The FOCBS shall inform the declarant, holder or owner of the items of the possibility of refusing to take samples on presentation of a reasoned request. The Administration shall set a suitable time limit for him or her to submit the request.

2 If the FOCBS permits the applicant to inspect the withheld items, it shall take appropriate consideration of the interests of the applicant and the declarant, holder or owner when determining the date of inspection.

Art. 39b Protection des secrets de fabrication et d’affaires

1 L’OFDF informe le déclarant, le possesseur ou le propriétaire des objets de la possibilité de refuser le prélèvement d’échantillons sur présentation d’une demande motivée. Il lui impartit un délai raisonnable pour présenter cette demande.

2 Si l’OFDF autorise le requérant à inspecter les objets retenus, il tient compte, pour fixer le moment de l’inspection, de manière appropriée des intérêts du requérant, d’une part, et de ceux du déclarant, du possesseur ou du propriétaire, d’autre part.
