Art. 17

1 The permitted use of a computer program in accordance with Article 12 paragraph 2 CopA includes:

a.
the use of the program in accordance with its intended purpose including loading, displaying, running, transmitting or storing the program as well as producing a copy of the work as required for carrying out these activities by the lawful acquirer;
b.
observing, studying or testing the functioning of the program for the purpose of determining the ideas and principles underlying a program element when this is done in the context of performing acts of use of the program in accordance with its intended purpose.

2 Necessary information on interfaces under Article 21 paragraph 1 CopA is information which is essential for establishing the interoperability of an independently developed program with other programs and which is not readily accessible to users of the program.

3 Unreasonable prejudice of the normal exploitation of the program within the meaning of Article 21 paragraph 2 CopA occurs in particular when the interface information obtained by decoding is used to develop, produce or commercialise a program that is expressed in a largely similar form.

Art. 17

1 L’utilisation licite d’un logiciel en vertu de l’art. 12, al. 2, LDA comprend:

a.
l’utilisation conforme du programme par l’acquéreur légitime, y compris le chargement, l’affichage, le passage, la transmission ou le stockage ainsi que la création d’un exemplaire de travail nécessaire à ces activités;
b.
le contrôle du fonctionnement du programme ainsi que son examen ou ses tests dans le but de rechercher des idées et des principes à la base d’un élément de programme lorsque cela s’effectue dans le cadre d’opérations découlant d’une utilisation conforme.

2 Aux termes de l’art. 21, al. 1, LDA, les informations nécessaires sur les interfaces sont celles qui sont indispensables à l’élaboration de l’interopérabilité d’un programme développé indépendamment avec d’autres programmes et qui ne sont pas librement accessibles à l’utilisateur du programme.

3 Il y a atteinte à l’exploitation normale du programme au sens de l’art. 21, al. 2, LDA, notamment lorsque les informations des interfaces obtenues lors du décryptage sont utilisées pour le développement, l’élaboration et la commercialisation d’un programme dont l’expression est fondamentalement similaire.
