1 At the applicant’s request, the obligor under the negotiable security may be forbidden to honour the security on presentation and warned of the danger of double payment.
2 Where a coupon sheet is to be annulled, the provision governing cancellation of bearer coupons applies mutatis mutandis to the individual coupons falling due during the proceedings.
1 Le débiteur ne peut opposer à l’action dérivant d’un titre au porteur que les exceptions tirées de la nullité du titre ou de son texte même, et celles qu’il a personnellement contre son créancier.
2 Il peut opposer les exceptions fondées sur ses rapports personnels avec un porteur antérieur, si le porteur, en acquérant le titre, a agi sciemment au détriment du débiteur.
3 Il ne peut exciper du fait que le titre a été mis en circulation contre son gré.
