Art. 433 b. Forfeiture and conversion into transaction for own account

1 The commission agent forfeits his right to commission if he has acted improperly towards the principal and in particular if he has secured an inflated purchase price or a deflated sale price.

2 Moreover, in both these cases the principal has the right to take action against the commission agent himself as buyer or seller.

Art. 432 a. Droit de la réclamer

1 La provision est due au commissionnaire si l’opération dont il était chargé a reçu son exécution, ou si l’exécution a été empêchée par une cause imputable au commettant.

2 Quant aux affaires qui n’ont pu être faites pour d’autres causes, le commissionnaire peut seulement réclamer, pour ses démarches, l’indemnité qui est due selon l’usage de la place.
