Art. 93 Return assistance and prevention of irregular migration

1 The Confederation shall provide return assistance. For this purpose, it may provide for the following measures:

a.
the full or partial funding of return counselling agencies;
b.
the full or partial funding of projects in Switzerland to preserve the ability of those concerned to return;
c.
the full or partial funding of programmes in the native country, country of origin or a third country to facilitate and arrange the return, repatriation and reintegration (programmes abroad);
d.
the granting of financial support in individual cases to facilitate the reintegration of returnees or provide them with temporary medical care in their native country, country of origin or third country.

2 Programmes abroad may also pursue the goal of contributing to the prevention of irregular migration. Irregular migration prevention programmes are those that contribute in the short term to limiting the risk of primary or secondary migration to Switzerland.

3 For the purpose of implementing return assistance, the Confederation may work with international organisations and set up a coordination office.

4 The Federal Council shall regulate the requirements and the payment and the accounting procedure for the subsidies.

Art. 93 Aide au retour et prévention de la migration irrégulière

1 La Confédération fournit une aide au retour. À cette fin, elle peut prévoir les mesures suivantes:

a.
le financement partiel ou intégral de services-conseils en vue du retour;
b.
le financement partiel ou intégral de projets, en Suisse, visant à maintenir l’aptitude des intéressés au retour;
c.
le financement partiel ou intégral de programmes réalisés dans l’État d’origine ou de provenance des intéressés ou dans un État tiers et visant à faciliter et à mener à bien leur retour, leur rapatriement et leur réintégration (programmes à l’étranger);
d.
l’octroi, selon le cas, d’une aide financière destinée à faciliter l’intégration des intéressés ou à leur procurer, durant une période limitée des soins médicaux dans leur État d’origine ou de provenance ou dans un État tiers.

2 Les programmes à l’étranger peuvent également viser à prévenir la migration irrégulière. Les programmes visant à prévenir la migration irrégulière sont ceux qui contribuent à réduire à court terme le risque d’une migration primaire ou secondaire en Suisse.

3 Dans le cadre de l’aide au retour, la Confédération peut collaborer avec des organisations internationales et instituer un bureau de coordination.

4 Le Conseil fédéral fixe les conditions et règle la procédure de versement et de décompte des contributions.
