Art. 15 Consultation without the client being physically present

(Art. 9 para. 2 and 63 let. c FinSA)

1 Consultation is deemed to take place without the client being physically present within the meaning of Article 9 paragraph 2 FinSA if:

a.
the parties are not at the same location; and
b.
on account of the communication medium used, it is not feasible with a reasonable amount of effort to make the key information document available to the retail client before the signing or conclusion of the contract.

2 In the case of consultation without the client being physically present, the retail client may generally consent to the key information document only being made available after conclusion of the transaction. This consent must be given in writing or in another form demonstrable via text separately from the consent given to the general terms and conditions.

3 Consent pursuant to paragraph 2 may be revoked in the same form at any time.

Art. 15 Beratung unter Abwesenden

(Art. 9 Abs. 2 und Art. 63 Bst. c FIDLEG)

1 Eine Beratung unter Abwesenden im Sinne von Artikel 9 Absatz 2 FIDLEG liegt vor, wenn:

a.
sich die Parteien nicht am selben Ort befinden; und
b.
es aufgrund des verwendeten Kommunikationsmittels mit angemessenem Aufwand nicht möglich ist, der Privatkundin oder dem Privatkunden das Basisinformationsblatt vor der Zeichnung oder dem Vertragsabschluss zur Verfügung zu stellen.

2 Die Privatkundin oder der Privatkunde kann in genereller Weise zustimmen, dass das Basisinformationsblatt bei Beratung unter Abwesenden erst nach Abschluss des Geschäfts zur Verfügung gestellt wird. Diese Zustimmung muss gesondert von derjenigen zu den allgemeinen Geschäftsbedingungen schriftlich oder in einer anderen Form, die den Nachweis durch Text ermöglicht, erfolgen.

3 Die Zustimmung nach Absatz 2 kann jederzeit in der gleichen Form widerrufen werden.
