Art. 37 Registration in the Patent Attorney Register in accordance with Article 19 PatAA

1 Any person who wishes to be registered in the Patent Attorney Register in accordance with Article 19 PatAA must submit the following to the IPI:

a.
for applications in accordance with Article 19 paragraph 1 letter a PatAA, proof of working professionally as a patent attorney in Switzerland and of a higher education qualification;
b.
for applications in accordance with Article 19 paragraph 1 letter b PatAA, proof of working professionally as a patent attorney in Switzerland and proof of registration in the list of professional representatives before the European Patent Office.

2 The application will not be deemed to have been made unless the registration fee has been paid within the time limit set by the IPI.

3 Where the documents submitted are incomplete or where there is doubt as to their correctness, the IPI may require that additional information or proof be provided.

4 Where the applicant does not fulfil the requirements for registration in the Register, the IPI will reject the application. The registration fee will not be refunded.

Art. 37 Eintragung in das Patentanwaltsregister nach Artikel 19 PAG

1 Wer sich nach Artikel 19 PAG in das Patentanwaltsregister eintragen lassen will, muss dem IGE einreichen:

a.
bei einem Antrag nach Artikel 19 Absatz 1 Buchstabe a PAG: einen Nachweis über die Ausübung der patentanwaltlichen Tätigkeit in der Schweiz und über den Hochschulabschluss;
b.
bei einem Antrag nach Artikel 19 Absatz 1 Buchstabe b PAG: einen Nachweis über die Ausübung der patentanwaltlichen Tätigkeit in der Schweiz und den Nachweis des Eintrags in die Liste der beim Europäischen Patentamt zugelassenen Vertreterinnen und Vertreter.

2 Der Antrag gilt nur als gestellt, wenn die Eintragungsgebühr innerhalb der vom IGE gesetzten Frist bezahlt ist.

3 Sind die eingereichten Unterlagen unvollständig oder bestehen Zweifel an deren Richtigkeit, so kann das IGE zusätzliche Informationen oder Nachweise verlangen.

4 Erfüllt die Antragstellerin oder der Antragsteller die Voraussetzungen für eine Eintragung in das Register nicht, so weist das IGE den Antrag ab. Die Eintragungsgebühr wird nicht zurückerstattet.
