935.411 Verordnung vom 24. Juni 2015 über die im Ausland erbrachten privaten Sicherheitsdienstleistungen (VPS)
Art. 5 Requirement to report identity
The company shall inform the State Secretariat FDFA of the identity of the principal or the recipient of a service under Article 4 letters a and b PSSA if the person or entity concerned is:
- a.
- a foreign state or its institutions;
- b.
- an international organisation or its institutions;
- c.
- a group that regards itself as the government or as a state institution, or its institutions;
- d.
- an organised armed group or its units participating in an armed conflict in terms of the Geneva Conventions13 and the Additional Protocols I and II14;
- e.
- a high representative of a foreign state or of an international organisation, a leader or a senior executive of a group under letters c and d, irrespective of whether the person concerns acts in the course of their duties or as a private individual.
Art. 5 Pflicht zur Meldung der Identität
Das Unternehmen informiert das Staatssekretariat EDA über die Identität der Auftraggeberin oder des Auftraggebers oder der Empfängerin oder des Empfängers einer Dienstleistung nach Artikel 4 Buchstaben a und b BPS, wenn es sich dabei handelt um:
- a.
- einen fremden Staat oder seine Organe;
- b.
- eine internationale Organisation oder ihre Organe;
- c.
- eine Gruppierung, die sich als Regierung oder als staatliches Organ betrachtet, oder ihre Organe;
- d.
- eine an einem bewaffneten Konflikt im Sinne der Genfer Konventionen13 und der Zusatzprotokolle I und II14 teilnehmende organisierte bewaffnete Gruppierung oder deren Einheiten;
- e.
- eine hohe Repräsentantin oder einen hohen Repräsentanten eines fremden Staates oder einer internationalen Organisation, eine Führungsperson oder ein hohes Kadermitglied einer Gruppierung nach den Buchstaben c und d, unabhängig davon, ob die betreffende Person in Ausübung ihrer Aufgaben oder als Privatperson handelt.
