935.411 Verordnung vom 24. Juni 2015 über die im Ausland erbrachten privaten Sicherheitsdienstleistungen (VPS)
Art. 1 Complex environment
1 A complex environment is any area:
- a.
- experiencing or recovering from unrest, or instability due to natural disaster or armed conflict in terms of the Geneva Conventions2 and Additional Protocols I and II3;
- b.
- where the rule of law has been substantially undermined; and
- c.
- in which the capacity of the state authority to handle the situation is limited or non-existent.
- 2 If the Confederation contracts with a company for the performance of protection tasks in an area that is not a complex environment in terms of paragraph 1, the Ordinance of 24 June 20154 on the Use of Private Security Companies applies.
Art. 1 Komplexes Umfeld
1 «Komplexes Umfeld» bezeichnet ein Gebiet:
- a.
- das entweder durch Unruhen oder durch eine Instabilität aufgrund von Naturkatastrophen oder bewaffneten Konflikten im Sinne der Genfer Konventionen2 und der Zusatzprotokolle I und II3 in Mitleidenschaft gezogen wurde oder immer noch wird;
- b.
- in dem rechtsstaatliche Strukturen erheblich beschädigt sind; und
- c.
- in dem die staatlichen Behörden der Situation nicht mehr oder nur noch in begrenztem Umfang gewachsen sind.
- 2 Setzt der Bund ein Unternehmen zur Wahrnehmung von Schutzaufgaben in einem Gebiet ein, das kein komplexes Umfeld nach Absatz 1 ist, so ist die Verordnung vom 24. Juni 20154 über den Einsatz von Sicherheitsunternehmen anwendbar.
