Art. 190 Monitoring of import, export and transit

1 In the course of import, export and transit controls, the customs offices shall check whether a licence has been obtained for the transport of radioactive material.

2 If so requested by the licensing authority, they shall check whether goods undergoing import, export and transit comply with the provisions of this Ordinance.

3 The FOPH shall organise the conduct of periodic targeted screening of goods undergoing import, export and transit and of persons entering the country; for this purpose, it shall consult in particular the Directorate General of Customs.

4 It shall coordinate, in particular with the Spiez Laboratory, requirements for, and the procurement and maintenance of, the necessary measuring equipment and shall prepare deployment in special situations.

5 It is responsible for approval of agreements concerning the possible take-back of exported radioactive waste as specified in Article 25 paragraph 3 letter d of the RPA.

6 The Directorate General of Customs, in consultation with the licensing authorities, shall issue internal directives for monitoring of the import, export and transit of radioactive material.

7 The Federal Office for Customs and Border Security61 may, on request, transfer data from customs declarations to the licensing and supervisory authorities.

Art. 190 Kontrolle von Ein-, Aus- und Durchfuhr

1 Die Zollstellen überprüfen im Rahmen ihrer Kontrollen bei der Ein-, Aus- und Durchfuhr, ob für den Transport von radioaktivem Material eine Bewilligung vorliegt.

2 Sie kontrollieren auf Ersuchen der Bewilligungsbehörde, ob Waren bei der Ein-, Aus- und Durchfuhr den Bestimmungen dieser Verordnung entsprechen.

3 Das BAG organisiert die Durchführung periodischer Schwerpunktkontrollen zur Überprüfung von Waren bei der Ein-, Aus- und Durchfuhr sowie von Personen bei der Einreise; es spricht sich dafür insbesondere mit der Oberzolldirektion ab.

4 Es koordiniert, insbesondere mit dem Labor Spiez, den Bedarf, die Beschaffung sowie den Unterhalt an erforderlichen Messeinrichtungen und bereitet den Einsatz in besonderen Situationen vor.

5 Es ist für die Zustimmung zu Vereinbarungen über eine allfällige Rücknahme ausgeführter radioaktiver Abfälle nach Artikel 25 Absatz 3 Buchstabe d StSG zuständig.

6 Die Oberzolldirektion erlässt im Einvernehmen mit den Bewilligungsbehörden interne Weisungen für die Kontrolle der Ein-, Aus- und Durchfuhr von radioaktivem Material.

7 Das Bundesamt für Zoll und Grenzsicherheit61 kann auf Anfrage die Daten aus den Zollanmeldungen an die Bewilligungs- und die Aufsichtsbehörden weitergeben.
