Art. 116 Incineration with the approval of the licensing authority

¹Combustible radioactive waste may, with the approval of the licensing authority, be incinerated at thermal waste treatment plants in accordance with the Waste Ordinance of 4 December 2015³⁸ if:

a.: compliance with the clearance limit can be demonstrated by monitoring of activity concentrations or calculation of the possible contamination of incineration residues;
b.: the radioactive waste only contains the radionuclides H-3 or C-14; and
c.: the activity approved for incineration per week does not exceed 1000 times the licensing limit.
²In justified cases, the licensing authority may approve the incineration of combustible radioactive waste containing radionuclides other than those specified in paragraph 1 letter b.

Art. 116 Verbrennung mit Zustimmung der Bewilligungsbehörde

¹ Brennbare radioaktive Abfälle können mit Zustimmung der Bewilligungsbehörde in Anlagen zur thermischen Behandlung von Abfällen nach der Abfallverordnung vom 4. Dezember 2015³⁸ verbrannt werden, wenn:

a.: durch eine Überwachung der Aktivitätskonzentration oder eine Berechnung der möglichen Kontamination der Verbrennungsrückstände die Einhaltung der Befreiungsgrenze nachgewiesen werden kann;
b.: die radioaktiven Abfälle nur die Radionuklide H-3 oder C-14 enthalten; und
c.: die wöchentlich zur Verbrennung zugelassene Aktivität das Tausendfache der Bewilligungsgrenze nicht überschreitet.

² In begründeten Fällen kann die Bewilligungsbehörde der Verbrennung brennbarer radioaktiver Abfälle zustimmen, die andere Radionuklide als diejenigen nach Absatz 1 Buchstabe b enthalten.
