Art. 61 Contraventions

¹ Liable to a fine not exceeding 20,000 francs is any person who wilfully:¹⁶³

a.: fails to comply with the limitations of emissions stipulated in this Act (Art. 12 and 34 para. 1);
b.: fails to comply with remediation orders (Art. 16 and 32c para. 1);
c.: fails to carry out officially ordered soundproofing measures (Art. 19–25);
d.: provides false or incomplete information or instructions (Art. 27);
e.: handles substances with no accompanying information or instructions in such a manner that they, their derivatives or waste may present a danger to the environment or indirectly endanger people (Art. 28);
f.: burns waste illegally outside installations (Art. 30c para. 2);
g.: deposits waste outside authorised landfills (Art. 30e para. 1);
h.: infringes the reporting duties in connection with waste (Art. 30f para. 4, 30g para. 2, 32b para. 2 and 3);
i.: infringes the regulations on waste (Art. 30a let. a and c, 30b, 30c para. 3, 30d, 30h para. 1, 32a^bis, 32b para. 4 and 32e para. 1–4);
k.: infringes the regulations on the movement of other forms of waste (Art. 30g para. 1);
l.: fails to guarantee coverage of the costs of closure, after-care and remediation of a landfill (Art. 32b para. 1);
m.: infringes the regulations on physical impacts on and the use of the soil (Art. 33 para. 2 and 34 para. 1 and 2) or on measures to reduce the soil pollution (Art. 34 para. 3);
m^bis.¹⁶⁴: infringes regulations on the traceability of timber and wood products and raw materials and products specified by the Federal Council pursuant to Article 35e paragraph 3 and for which a documentation requirement has been imposed (Art. 35g para. 1);
n.: infringes the regulations on placing series-produced installations¹⁶⁵ on the market (Art. 40);
o.: refuses to provide information to the competent authority or provides incorrect information (Art. 46);
p.¹⁶⁶: infringes the regulations on providing a guarantee for liability (Art. 59b).

Art. 61 Übertretungen

¹ Mit Busse bis zu 20 000 Franken wird bestraft, wer vorsätzlich:¹⁶³

a.: aufgrund dieses Gesetzes erlassene Emissionsbegrenzungen verletzt (Art. 12 und 34 Abs. 1);
b.: Sanierungsverfügungen nicht befolgt (Art. 16 und 32c Abs. 1);
c.: behördlich verfügte Schallschutzmassnahmen nicht trifft (Art. 19–25);
d.: falsch oder unvollständig informiert oder anweist (Art. 27);
e.: mit Stoffen, denen keine Informationen oder Anweisungen beiliegen, so umgeht, dass sie, ihre Folgeprodukte oder Abfälle die Umwelt oder mittelbar den Menschen gefährden können (Art. 28);
f.: widerrechtlich Abfälle ausserhalb von Anlagen verbrennt (Art. 30c Abs. 2);
g.: Abfälle ausserhalb von bewilligten Deponien ablagert (Art. 30e Abs. 1);
h.: Meldepflichten im Zusammenhang mit Abfällen verletzt (Art. 30f Abs. 4, 30g Abs. 2, 32b Abs. 2 und 3);
i.: Vorschriften über Abfälle verletzt (Art. 30a Bst. a und c, 30b, 30c Abs. 3, 30d, 30h Abs. 1, 32a^bis, 32b Abs. 4 und 32e Abs. 1–4);
k.: Vorschriften über den Verkehr mit anderen Abfällen verletzt (Art. 30g Abs. 1);
l.: die Kosten für den Abschluss, die Nachsorge und die Sanierung einer Deponie nicht sicherstellt (Art. 32b Abs. 1);
m.: Vorschriften über physikalische Belastungen und die Nutzung des Bodens (Art. 33 Abs. 2 und 34 Abs. 1 und 2) sowie über Massnahmen zur Verminderung der Bodenbelastung (Art. 34 Abs. 3) verletzt;
m^bis.¹⁶⁴: Vorschriften über die Rückverfolgbarkeit von Holz und Holzerzeugnissen sowie von Rohstoffen und Produkten, die vom Bundesrat nach Artikel 35e Absatz 3 bezeichnet wurden und für die eine Dokumentationspflicht festgelegt wurde, verletzt (Art. 35g Abs. 1);
n.: Vorschriften über das Inverkehrbringen serienmässig hergestellter Anlagen¹⁶⁵ verletzt (Art. 40);
o.: von der zuständigen Behörde verlangte Auskünfte verweigert oder unrichtige Angaben macht (Art. 46);
p.¹⁶⁶: Vorschriften über die Sicherstellung der Haftpflicht verletzt (Art. 59b).

² Handelt der Täter fahrlässig, so ist die Strafe Busse.

³ Versuch und Gehilfenschaft sind strafbar.
