Art. 62c Treated articles

1 By way of derogation from Article 31 paragraph 1, a treated article may, after the commencement of the Amendment of 20 June 2014 to this Ordinance, be placed on the market for the first time until the date specified in paragraph 2 if it meets one of the following conditions:249

a.
It was treated with or intentionally incorporates one or more biocidal products containing only active substances that are included in the list of notified active substances.
b.
For the active substances it contains, an application for approval for the relevant product type is submitted to the European Commission by 1 September 2016.
c.
It contains only a combination of active substances included in the list of notified active substances and active substances included in the list drawn up in Annex 2 for the relevant product type and use or included in Annex 1.

2 The treated articles specified in paragraph 1 may be placed on the market for the first time until one of the following dates:250

a.
the date on which approval is granted by the European Commission for the relevant product type and use of the last active substance which is to be authorised and is contained in the biocidal product;
b.
the date falling 180 days after a decision by the European Commission not to approve one of the active substances for the relevant use.

3 A treated article treated with or intentionally incorporating one or more biocidal products containing any active substances other than those referred to in paragraph 1 letters a–c may be placed on the market for the first time until 28 February 2017.251

Art. 62c Behandelte Waren

1 Eine behandelte Ware darf nach Inkrafttreten der Änderung vom 20. Juni 2014 dieser Verordnung in Abweichung von Artikel 31 Absatz 1 bis zum Zeitpunkt nach Absatz 2 erstmals in Verkehr gebracht werden, wenn sie eine der folgenden Voraussetzungen erfüllt:249

a.
Sie wurde mit einem oder mehreren Biozidprodukten behandelt oder ihr wurden ein oder mehrere Biozidprodukte absichtlich zugesetzt, die nur Wirkstoffe enthalten, die in der Liste der notifizierten Wirkstoffe enthalten sind.
b.
Es wurde für die Wirkstoffe, die sie enthält, bis spätestens 1. September 2016 bei der Europäischen Kommission ein Antrag auf Genehmigung für die betreffende Produktart gestellt.
c.
Sie enthält nur eine Kombination von Wirkstoffen, die in der Liste der notifizierten Wirkstoffe enthalten sind, und von Wirkstoffen, die in der in Anhang 2 für die betreffenden Produktarten und Verwendungszwecke erstellten Liste oder in Anhang 1 enthalten sind.

2 Die behandelten Waren nach Absatz 1 dürfen bis zum folgenden Zeitpunkt erstmals in Verkehr gebracht werden:250

a.
bis zu dem Zeitpunkt, zu dem der letzte im Biozidprodukt enthaltene zulassungspflichtige Wirkstoff für die betreffende Produktart und Verwendung von der Europäischen Kommission genehmigt wurde;
b.
bis 180 Tage nach der Entscheidung der Europäischen Kommission, einen der Wirkstoffe für die betreffende Verwendung nicht zu genehmigen.

3 Eine behandelte Ware, die mit einem oder mehreren Biozidprodukten behandelt wurde oder der ein oder mehrere Biozidprodukte absichtlich zugesetzt wurden, die einen anderen Wirkstoff als diejenigen enthalten, auf die in Absatz 1 Buchstaben a–c verwiesen wird, darf bis zum 28. Februar 2017 erstmals in Verkehr gebracht werden.251
