813.12 Verordnung vom 18. Mai 2005 über das Inverkehrbringen von und den Umgang mit Biozidprodukten (Biozidprodukteverordnung, VBP)

Art. 50 Advertising

1 Biocidal products must not be promoted unless they:

a.
are authorised; or
b.
are placed on the market or used in accordance with Article 3 paragraph 3 letter a or b.

2 Article 38 paragraph 1 applies mutatis mutandis to advertising.

3 Any advertisement for biocidal products must include the following phrases, which shall be clearly distinguishable and legible in relation to the whole advertisement:

a.
«Use biocides safely»; the word «biocides» may be replaced with a reference to the product type according to Annex 10;
b.
«Always read the label and product information before use».

4 Anyone who advertises dangerous biocidal products which the general public can purchase without seeing the labelling beforehand must indicate their hazardous properties in a comprehensible and clearly legible or audible manner.

5 Otherwise, Article 60 and, for samples, Article 68 of the ChemO215 apply mutatis mutandis.216

Art. 50 Werbung

1 Es dürfen nur Biozidprodukte angepriesen werden, die:

a.
zugelassen sind; oder
b.
nach Artikel 3 Absatz 3 Buchstabe a oder b in Verkehr gebracht oder verwendet werden.

2 Für die Werbung gilt Artikel 38 Absatz 1 sinngemäss.

3 Die Werbung für jedes Biozidprodukt muss, gut lesbar und von der eigentlichen Werbung deutlich abgehoben, folgende Aussagen enthalten:

a.
«Biozide vorsichtig verwenden»; anstelle von «Biozid» kann die Produktart nach Anhang 10 angegeben werden;
b.
«Vor Gebrauch stets Etikett und Produktinformationen lesen».

4 Wer für gefährliche Biozidprodukte wirbt, welche die breite Öffentlichkeit kaufen kann, ohne vorher die Kennzeichnung gesehen zu haben, muss in allgemeinverständlicher und deutlich lesbarer oder hörbarer Form auf die gefährlichen Eigenschaften hinweisen.

5 Im Übrigen gilt Artikel 60 ChemV215 und für Warenmuster Artikel 68 ChemV sinngemäss.216
