Art. 11f Special provisions for biocidal product families

1 A biocidal product family must be assessed according to the common principles specified in Annex VI to Regulation (EU) No 528/201289. The assessment must consider the maximum risks to human health, animal health and the environment and the minimum level of efficacy over the whole potential range of products within the biocidal product family.

2 A biocidal product family shall only be authorised if:

a.
the following are explicitly identified in the application:
1.
the maximum risks to human health, animal health and the environment, and the minimum level of efficacy, on which the applicant’s assessment is based, and
2.
the permitted variations in composition and uses referred to in Article 2 paragraph 2 letter b, together with the respective classification, hazard and precautionary statements and any appropriate risk mitigation measures; and
b.
it is evident from the assessment referred to in paragraph 1 that all the biocidal products within the family comply with the conditions specified in Article 11.

Art. 11f Besondere Bestimmungen für Biozidproduktefamilien

1 Eine Biozidproduktefamilie muss nach den gemeinsamen Grundsätzen von Anhang VI der Verordnung (EU) Nr. 528/201289 bewertet werden. Dabei sind die Maximalrisiken für die Gesundheit von Mensch und Tier sowie für die Umwelt und das Mindestwirksamkeitsniveau über den gesamten möglichen Produktbereich innerhalb der Biozidproduktefamilie zu berücksichtigen.

2 Eine Biozidproduktefamilie wird nur zugelassen, wenn:

a.
aus dem Gesuch Folgendes explizit hervorgeht:
1.
die Maximalrisiken für die Gesundheit von Mensch und Tier und für die Umwelt sowie das Mindestwirksamkeitsniveau, auf welchen die Bewertung der Gesuchstellerin basiert, und
2.
die erlaubten Abweichungen in der Zusammensetzung und Verwendung nach Artikel 2 Absatz 2 Buchstabe b, zusammen mit der jeweiligen Einstufung, den Gefahren- und Sicherheitshinweisen sowie gegebenenfalls entsprechende Risikobegrenzungsmassnahmen; und
b.
sich aus der Bewertung nach Absatz 1 ergibt, dass alle Biozidprodukte innerhalb der Familie die Voraussetzungen nach Artikel 11 erfüllen.
