Art. 80

1 The assessment authorities may review any existing substances which:

a.133
may represent a particular risk to human life or health or to the environment, owing to the quantities manufactured or placed on the market or owing to their dangerous nature or the dangerous nature of their secondary products or wastes; or
b.
are included in an international existing substances programme.

2 If an existing substance is to be reviewed, the Notification Authority, at the request of an assessment authority, shall require all the manufacturers concerned to provide the following information:

a.
the name and address of the manufacturer, and the name and address of the foreign manufacturer if the manufacturer imports the substance;
b.
all documents used in assessing and establishing the hazardous properties of the substance;
c.
the known uses;
d.
information on the quantities placed on the market by the manufacturers;
e.
the registration dossier submitted to the European Chemicals Agency, provided it is available and can be obtained by the notifier with reasonable effort.

3 If requested by an assessment authority, the Notification Authority shall request one of the manufacturers to carry out investigations or studies. The costs incurred by the manufacturer shall be borne jointly by all the manufacturers concerned.

Art. 80

1 Die Beurteilungsstellen können alte Stoffe überprüfen, die:

a.133
aufgrund der hergestellten oder in Verkehr gebrachten Mengen oder aufgrund ihrer Gefährlichkeit oder der Gefährlichkeit ihrer Folgeprodukte oder Abfälle ein besonderes Risiko für das Leben oder die Gesundheit des Menschen oder für die Umwelt darstellen können; oder
b.
Gegenstand eines internationalen Altstoff-Programms sind.

2 Soll ein alter Stoff überprüft werden, so verlangt die Anmeldestelle auf Antrag einer Beurteilungsstelle von allen betroffenen Herstellerinnen folgende Angaben:

a.
Name und Adresse der Herstellerin sowie Name und Adresse der ausländischen Herstellerin, falls die Herstellerin den Stoff einführt;
b.
alle Unterlagen, die zur Ermittlung und Feststellung der gefährlichen Eigenschaften des Stoffs gedient haben;
c.
die bekannten Verwendungszwecke;
d.
Angaben über die von den Herstellerinnen in Verkehr gebrachten Mengen;
e.
soweit vorhanden und von der Herstellerin mit zumutbarem Aufwand zu beschaffen: das Registrierungsdossier, das der Europäischen Chemikalienagentur eingereicht wurde.

3 Auf Antrag einer Beurteilungsstelle verlangt die Anmeldestelle von einer der Herstellerinnen Abklärungen oder Untersuchungen. Für die der Herstellerin entstehenden Kosten haften alle betroffenen Herstellerinnen solidarisch.
