Art. 35 Form and content of the declaration

¹ The declaration must be written in an official language or in English and be submitted electronically in the format required by the Notification Authority. The accompanying letter must be written in an official language.

² The declaration must contain the following information and documents:

a.: the name and address of the manufacturer;
b.: if the manufacturer has imported the substance: the name and address of the foreign manufacturer;
c.: essential data relating to the identity of the substance;
d.: the intended uses;
e.: the amount of the substance that the manufacturer expects to place on the market each year in Switzerland;
f.: proposed classification and labelling;
g.: the research programme and a list of the people to whom the substance is to be supplied;
h.: in the case of dangerous substances or PBT or vPvB substances: a proposed safety data sheet.

³ The Notification Authority may request the manufacturer or only representative to furnish test reports that are relevant for the assessment of the substance, provided that they are available and can be obtained with reasonable effort.

Art. 35 Form und Inhalt der Mitteilung

¹ Die Mitteilung muss in einer Amtssprache oder auf Englisch und in dem von der Anmeldestelle verlangten Format elektronisch eingereicht werden. Das Begleitschreiben muss in einer Amtssprache eingereicht werden.

² Die Mitteilung muss folgende Daten und Unterlagen umfassen:

a.: Name und Adresse der Herstellerin;
b.: falls die Herstellerin den Stoff eingeführt hat: Name und Adresse der ausländischen Herstellerin;
c.: die wesentlichen Angaben zur Identität des Stoffs;
d.: die Verwendungszwecke;
e.: die voraussichtliche Menge des Stoffs, die die Herstellerin jährlich in der Schweiz in Verkehr bringen wird;
f.: die vorgesehene Einstufung und Kennzeichnung;
g.: das Forschungsprogramm und eine Liste der Personen, an die der Stoff abgegeben werden soll;
h.: bei gefährlichen Stoffen oder PBT- oder vPvB-Stoffen: einen Vorschlag für ein Sicherheitsdatenblatt.

³ Die Anmeldestelle kann von der Herstellerin oder der Alleinvertreterin Prüfberichte verlangen, die für die Beurteilung des Stoffs relevant sind, sofern die Prüfberichte vorhanden sind und mit zumutbarem Aufwand beschafft werden können.
