Art. 46 Data exchange with foreign countries and with international organisations

1 The Federal Council shall establish responsibilities and procedures for the exchange of data with foreign authorities and institutions and with international organisations.

2 Confidential information may only be disclosed to foreign authorities and institutions or to international organisations if:

a.
this is required by international agreements or the resolutions of international organisations; or
b.
it is imperative in order to avert an imminent hazard to life or health.

Art. 46 Datenaustausch mit dem Ausland und mit internationalen Organisationen


1 Der Bundesrat regelt Zuständigkeiten und Verfahren für den Austausch von Daten mit ausländischen Behörden und Institutionen sowie mit internationalen Organisationen.

2 Vertrauliche Angaben dürfen an ausländische Behörden und Institutionen sowie an internationale Organisationen nur weitergegeben werden, wenn:

a.
völkerrechtliche Vereinbarungen oder Beschlüsse internationaler Organisationen dies erfordern; oder
b.
es zur Abwendung unmittelbar drohender Gefahr für Leben oder Gesundheit unbedingt erforderlich ist.
