Art. 21 Waiting list

1 Persons are placed on the waiting list in accordance with Article 17 paragraph 2. The Federal Council shall determine which persons who do not meet the requirements of Article 17 paragraph 2 are also placed on the waiting list.20

2 The transplant centres shall decide whom to place on or remove from the waiting list. They may take only medical reasons into account. Article 17 paragraph 1 applies mutatis mutandis.

3 The transplant centres shall communicate their decisions with the necessary data to the national organ allocation office.

4 The Federal Council shall specify in more detail:

a.
the medical reasons according to paragraph 2;
b.
the necessary data according to paragraph 3.

Art. 21 Warteliste

1 In die Warteliste aufgenommen werden Personen nach Artikel 17 Absatz 2. Der Bundesrat legt fest, welche Personen, die die Anforderungen nach Artikel 17 Absatz 2 nicht erfüllen, ebenfalls in die Warteliste aufgenommen werden.20

2 Die Transplantationszentren entscheiden, wer in die Warteliste aufzunehmen oder daraus zu streichen ist. Sie dürfen dabei nur medizinische Gründe berücksichtigen. Artikel 17 Absatz 1 gilt sinngemäss.

3 Die Transplantationszentren teilen ihre Entscheide zusammen mit den erforderlichen Daten der Nationalen Zuteilungsstelle mit.

4 Der Bundesrat umschreibt näher:

a.
die medizinischen Gründe nach Absatz 2;
b.
die erforderlichen Daten nach Absatz 3.
