Art. 50 Restriction, suspension and withdrawal of the licence

1 DETEC may restrict, suspend or withdraw the licence if:

a.
the licensee has acquired it as a result of incomplete or incorrect information;
b.
the licensee seriously violates this Act or its implementing provisions;
c.
the licensee continuously fails to meet its obligations laid down in the licence despite measures under Article 47 paragraph 2;
d.
the licensee seriously exploits the licence for unlawful purposes;
e.
important national interests so require.

2 DETEC shall withdraw the licence if essential conditions relating to the award thereof are no longer applicable.

3 The licensee has a claim to compensation if DETEC:

a.
withdraws the licence because essential conditions relating to the award thereof cease to exist and the Confederation is responsible for this;
b.
suspends or withdraws the licence because important national interests so require.

Art. 50 Einschränkung, Suspendierung und Entzug der Konzession

1 Das UVEK kann die Konzession einschränken, suspendieren oder entziehen, wenn:

a.
der Konzessionär sie durch unvollständige oder unrichtige Angaben erwirkt hat;
b.
der Konzessionär in schwerwiegender Weise gegen dieses Gesetz und die Ausführungsbestimmungen verstösst;
c.
der Konzessionär trotz Massnahmen nach Artikel 47 Absatz 2 dauernd gegen seine in der Konzession festgelegten Pflichten verstösst;
d.
der Konzessionär die Konzession in schwerwiegender Weise zu rechtswidrigen Zwecken benützt;
e.
wichtige Landesinteressen es erfordern.

2 Das UVEK entzieht die Konzession, wenn wesentliche Voraussetzungen zu ihrer Erteilung dahingefallen sind.

3 Der Konzessionär hat Anspruch auf Entschädigung, wenn das UVEK:

a.
die Konzession entzieht, weil wesentliche Voraussetzungen zu ihrer Erteilung dahingefallen sind und der Bund dafür einstehen muss;
b.
die Konzession suspendiert oder entzieht, weil wichtige Landesinteressen es erfordern.
