Art. 27 Authorisation for making available on the market

1 Any person wishing to make radio equipment in accordance with Article 26 paragraph available on the market must first obtain authorisation from OFCOM. OFCOM may make authorisation subject to terms and conditions. It shall issue the required administrative regulations.

2 In the event of any failure to comply with the terms and conditions of authorisation, OFCOM may revoke the authorisation without compensation.

3 OFCOM shall provide the authorities under paragraph 4 with a list of persons who have received authorisation, and a list of equipment authorised in accordance with Article 26 paragraph 1.

4 The radio equipment referred to in Article 26 paragraph 1 may only be offered or made available on the market to:

a.
the police, the prosecution or prison and probation authorities;
b.
the Federal Intelligence Service;
c.
the Armed Forces;
d.
authorities responsible for conducting searches for missing persons and for convicted persons.35

Art. 27 Bewilligung der Bereitstellung auf dem Markt

1 Wer Funkanlagen nach Artikel 26 Absatz 1 auf dem Markt bereitstellen will, muss vorgängig eine Bewilligung des BAKOM einholen. Dieses kann die Bewilligung mit Bedingungen und Auflagen ergänzen. Es erlässt die notwendigen administrativen Vorschriften.

2 Werden die Bedingungen und Auflagen der Bewilligung nicht eingehalten, so kann das BAKOM die Bewilligung entschädigungslos entziehen.

3 Das BAKOM stellt den Behörden nach Absatz 4 eine Liste mit den Personen, die eine Bewilligung nach Absatz 1 innehaben, und eine Liste der zugelassenen Anlagen nach Artikel 26 Absatz 1 zur Verfügung.

4 Die Funkanlagen nach Artikel 26 Absatz 1 dürfen nur angeboten oder auf dem Markt bereitgestellt werden für:

a.
Polizei-, Strafverfolgungs- oder Strafvollzugsbehörden;
b.
den Nachrichtendienst des Bundes;
c.
die Armee;
d.
Behörden, die für die Durchführung von Notsuchen sowie Fahndungen nach verurteilten Personen zuständig sind.35
