Art. 20 Recording personal details in the case of mobile services

1 In the case of mobile services, TSPs and retailers in accordance with Article 2 letter f SPTA must, on supplying the means of access or on the initial activation of the service, verify the identity of the subscriber by means of a passport, an identity card or a foreign national identity card in accordance with Article 71 and 71a of the Ordinance of 24 October 200711 on Admission, Period of Stay and Employment. They must retain an easily legible copy of the identity document.

2 In the case of the natural persons, the following details must be recorded:

a.
surnames and forenames;
b.
date of birth;
c.
type of identity document, identity document number and the issuing country or issuing organisation;
d.
address;
e.
if known, occupation;
f.
nationality.

3 In the case of legal entities, the following details must be recorded:

a.
name, registered office and contact details for the legal entity;
b.
business identification number (UID) in accordance with the Federal Act of 18 June 201012 on the Business Identification Number;
c.
if available, the names and forenames of the persons who will use the provider’s services.

4 In the case of customer relationships that are not based on a subscription contract, the following details must also be recorded:

a.
the time at which the means of access was supplied;
b.
the point of supply (name and complete address);
c.
the name of the person supplying the means of access.

Art. 20 Erfassung von Angaben zur Person bei Mobilfunkdiensten

1 Bei Mobilfunkdiensten müssen die FDA und die Wiederverkäuferinnen gemäss Artikel 2 Buchstabe f BÜPF bei der Abgabe des Zugangsmittels oder bei der erstmaligen Aktivierung des Dienstes die Identität des Teilnehmenden anhand eines Reisepasses, einer Identitätskarte oder eines Ausländerausweises im Sinne der Artikel 71 und 71a der Verordnung vom 24. Oktober 200711 über Zulassung, Aufenthalt und Erwerbstätigkeit überprüfen. Es ist eine gut lesbare Ausweiskopie aufzubewahren.

2 Bei natürlichen Personen sind folgende Angaben zu erfassen:

a.
die Namen und die Vornamen;
b.
das Geburtsdatum;
c.
die Art des Ausweises, die Ausweisnummer und das ausstellende Land beziehungsweise die ausstellende Organisation;
d.
die Adresse;
e.
falls bekannt, der Beruf;
f.
die Nationalität.

3 Bei juristischen Personen sind folgende Angaben zu erfassen:

a.
der Name, der Sitz und die Kontaktdaten der juristischen Person;
b.
die Unternehmens-Identifikationsnummer (UID) gemäss dem Bundesgesetz vom 18. Juni 201012 über die Unternehmens-Identifikationsnummer;
c.
falls vorhanden, die Namen und Vornamen der Personen, die die Dienste der Anbieterin in Anspruch nehmen.

4 Bei Kundenbeziehungen ohne Abonnementsverhältnis sind zudem folgende Angaben zu erfassen:

a.
der Zeitpunkt der Abgabe der Zugangsmittel;
b.
die Abgabestelle (Name und vollständige Adresse);
c.
der Name der abgebenden Person.
