Art. 139

1 Installation operators participating in the ETS or installation operators with reduction obligations may apply to the FOEN to carry-over a maximum of as many unused emission-reduction certificates from the 2008–2012 period into the 2013–2020 period as it is anticipated they will be permitted to surrender to meet their obligations under this Ordinance.376

2 Only emission reduction certificates that comply with the requirements of Article 4 may be carried over.

3 The FOEN determines the total amount that may be carried over on the basis of Switzerland’s international commitments.

4 Installation operators participating in the ETS and installation operators with reduction obligations are given priority for the carry over.377

5 Emission-reduction certificates that have not been carried over can be surrendered towards meeting commitments under this Ordinance by 30 April 2015 if they comply with the requirements of Article 4.378

6 Emission-reduction certificates that have not been carried over will be cancelled by the FOEN after 30 April 2015.379

Art. 138 Umwandlung nicht verwendeter Emissionsrechte

1 Emissionsrechte, die in den Jahren 2008–2012 nicht verwendet wurden, werden am 30. Juni 2014 umgewandelt:

a.
für Betreiber von Anlagen im EHS: in Emissionsrechte nach dieser Verordnung;
b.
für Betreiber von Anlagen mit Verminderungsverpflichtung: in Gutschriften zur Kompensation einer allfälligen Nichterreichung ihrer Emissions- oder Massnahmenziele;
c.
für die übrigen Unternehmen und Personen: in Bescheinigungen für Emissionsverminderungen im Inland.

2 Betreiber von Anlagen mit Verminderungsverpflichtung können jederzeit beantragen, dass ihre Gutschriften nach Absatz 1 Buchstabe b in Bescheinigungen umgewandelt werden.
