1 The request for the third party action to be admitted must be made with the answers or the reply in the main proceedings. The notifying party shall set out the prayers to be raised against the third party together with a brief statement of the grounds.
2 The court shall give the opposing party and the third party the opportunity to respond.
3 If the third party action is admitted, the court shall determine the time and extent of the related exchange of written submissions, subject to Article 125.
4 The decision to admit the third party action may be challenged by way of objection.
1 Die streitverkündende Partei kann ihre Ansprüche, die sie im Falle des Unterliegens gegen die streitberufene Person zu haben glaubt, beim Gericht, das mit der Hauptklage befasst ist, geltend machen.
2 Die streitberufene Person kann keine weitere Streitverkündungsklage erheben.
3 Im vereinfachten und im summarischen Verfahren ist die Streitverkündungsklage unzulässig.
