Art. 247 Establishment of facts

1 By asking the appropriate questions, the court shall cause the parties to complete inadequate submissions and to designate the evidence.

2 In the following cases, the court shall establish the facts ex officio:

a.
in matters under Article 243 paragraph 2;
b.
if the value in dispute does not exceed 30,000 francs:
1.
in other disputes concerning the tenancy and lease of residential and business property or the lease of agricultural property,
2.
in other employment law disputes.

Art. 246 Prozessleitende Verfügungen

1 Das Gericht trifft die notwendigen Verfügungen, damit die Streitsache möglichst am ersten Termin erledigt werden kann.

2 Erfordern es die Verhältnisse, so kann das Gericht einen Schriftenwechsel anordnen und Instruktionsverhandlungen durchführen.
