Art. 34 Examination of the processing of personal data

1 For the investigation of the circumstances under Articles 27 and 29 DPA, and in particular the examination of the lawfulness of data processing, the Commissioner may request the following information in particular from the controller of the data file:

a.
technical and organisational measures (Art. 8–10, 20) that have been taken or that are planned;
b.
the regulations relating to the correction, blocking, rendering anonymous, storing, safeguarding and destruction of personal data;
c.
the configuration of the information technology used;
d.
links with other data files;
e.
the manner of the disclosure the data;
f.
the description of the data fields and the organisational units that have access to them;
g.
the nature and extent of access by users to the data in the data file.

2 In the case of transborder disclosure, the Commissioner may request additional information, in particular on the processing possibilities of the data recipient or on the data protection measures taken.

Art. 34 Prüfung der Datenbearbeitung von Personendaten

1 Für die Abklärung des Sachverhalts nach den Artikeln 27 und 29 DSG, insbesondere bei der Prüfung der Rechtmässigkeit der Datenbearbeitung, kann der Beauftragte vom Inhaber der Datensammlung insbesondere folgende Auskünfte verlangen:

a.
technische und organisatorische Massnahmen (Art. 8–10, 20), die getroffen wurden oder geplant sind;
b.
die Regelungen betreffend Berichtigung, Sperrung, Anonymisierung, Speicherung, Aufbewahrung und Vernichtung von Personendaten;
c.
die Konfiguration der Informatikmittel;
d.
die Verknüpfungen mit anderen Datensammlungen;
e.
die Art der Bekanntgabe der Daten;
f.
die Beschreibung der Datenfelder und die Organisationseinheiten, die darauf Zugriff haben;
g.
Art und Umfang des Zugriffs der Benutzer auf die Daten der Datensammlung.

2 Bei Bekanntgaben ins Ausland kann der Beauftragte zusätzliche Angaben verlangen, insbesondere über die Bearbeitungsmöglichkeiten des Datenempfängers oder über die zum Datenschutz getroffenen Massnahmen.
