Art. 4 Grounds for refusal

A design may not be protected if:

a.
the design filed is not in accordance with Article 1;
b.
the design does not meet the requirements of Article 2 at the time of filing;
c.
the features of the design are dictated solely by the technical function of the product;
d.
the design infringes federal law or international treaties;
e.
the design is contrary to public policy or morality.

Art. 4 Ausschlussgründe

Der Designschutz ist ausgeschlossen, wenn:

a.
kein Design im Sinne von Artikel 1 hinterlegt ist;
b.
das Design im Zeitpunkt der Hinterlegung die Voraussetzungen nach Artikel 2 nicht erfüllt;
c.
die Merkmale des Designs ausschliesslich durch die technische Funktion des Erzeugnisses bedingt sind;
d.
das Design Bundesrecht oder Staatsverträge verletzt;
e.
das Design gegen die öffentliche Ordnung oder die guten Sitten verstösst.
