Art. 52o

A place of effective administration under Article 49 TmPA is presumed to be the place where:

a.
the activities which are essential to the fulfilment of the commercial purpose are carried out; and
b.
the decisions which determine the provision of the service are made.

Art. 52o

Als ein Ort der tatsächlichen Verwaltung nach Artikel 49 MSchG wird der Ort vermutet, an dem:

a.
für die Erreichung des Geschäftszwecks massgebliche Tätigkeiten ausgeübt werden; und
b.
für das Erbringen der Dienstleistung massgebliche Entscheide getroffen werden.
