Art. 45 Application for registration in the International Register

1 It is possible to request the following through the intermediary of the IPI:

a.
the international registration of a trade mark provided that Switzerland is the country of origin in accordance with Article 1 paragraph 3 of the Madrid Agreement48, or Article 2 paragraph 1 of the Madrid Protocol49;
b.
the modification of an international registration provided that Switzerland is the country of the proprietor of the trade mark in accordance with the Madrid Agreement or the Madrid Protocol;
c.
the international registration of an application provided that Switzerland is the country of origin in accordance with Article 2 paragraph 1 of the Madrid Protocol.

2 The fees as set out in the Madrid Agreement, the Madrid Protocol and in the Ordinance must be paid for the international registration of a trade mark, an application for registration or the modification of an international registration.

Art. 45 Gesuche um Registrierungen im internationalen Register

1 Durch Vermittlung des IGE können veranlasst werden:

a.
die internationale Registrierung einer Marke, wenn die Schweiz Ursprungsland im Sinne von Artikel 1 Absatz 3 des Madrider Markenabkommens48 oder von Artikel 2 Absatz 1 des Madrider Protokolls49 ist;
b.
die Änderung einer internationalen Registrierung, wenn die Schweiz das Land des Markeninhabers im Sinne des Madrider Markenabkommens oder des Madrider Protokolls ist;
c.
die internationale Registrierung eines Eintragungsgesuchs, wenn die Schweiz Ursprungsland im Sinne von Artikel 2 Absatz 1 des Madrider Protokolls ist.

2 Für die internationale Registrierung einer Marke oder eines Eintragungsgesuchs oder für die Änderung einer internationalen Registrierung sind die im Madrider Markenabkommen, im Madrider Protokoll und in der Verordnung dafür vorgesehenen Gebühren zu bezahlen.
