1 A contract of surety for the performance of official obligations concluded for an indefinite term may be terminated subject to one year’s notice expiring at the end of a term of office.
2 Where there is no fixed term of office, the surety may terminate the contract by giving one year’s notice expiring at the end of a four-year period commencing when the office was taken up.
3 A person standing surety for the performance of civil service obligations for an indefinite term has the same right to give notice of termination as under an open-ended contract of surety for official obligations.
4 Agreements to the contrary are unaffected.
1 Ist die Bürgschaft auf unbestimmte Zeit eingegangen, so kann der Bürge nach Eintritt der Fälligkeit der Hauptschuld vom Gläubiger verlangen, dass er, soweit es für seine Belangbarkeit Voraussetzung ist, binnen vier Wochen die Forderung gegenüber dem Hauptschuldner rechtlich geltend macht, die Verwertung allfälliger Pfänder einleitet und den Rechtsweg ohne erhebliche Unterbrechung verfolgt.
2 Handelt es sich um eine Forderung, deren Fälligkeit durch Kündigung des Gläubigers herbeigeführt werden kann, so ist der Bürge nach Ablauf eines Jahres seit Eingehung der Bürgschaft zu dem Verlangen berechtigt, dass der Gläubiger die Kündigung vornehme und nach Eintritt der Fälligkeit seine Rechte im Sinne der vorstehenden Bestimmung geltend mache.
3 Kommt der Gläubiger diesem Verlangen nicht nach, so wird der Bürge frei.
