Art. 1180 1. Authority of the bond representative

1 The consent of persons representing more than one-half of the bond capital in circulation is required to revoke or modify the authority conferred on a bond representative.

2 The same majority is required for a resolution to grant a bond representative authority to safeguard the rights of all the bond creditors in insolvency proceedings.

Art. 1177 b. Voraussetzungen

Die Genehmigung darf nur verweigert werden:

1.
wenn die Vorschriften über die Einberufung und das Zustandekommen der Beschlüsse der Gläubigerversammlung verletzt worden sind;
2.
wenn der zur Abwendung einer Notlage des Schuldners gefasste Beschluss sich als nicht notwendig herausstellt;
3.
wenn die gemeinsamen Interessen der Anleihensgläubiger nicht genügend gewahrt sind;
4.
wenn der Beschluss auf unredliche Weise zustande gekommen ist.
