Art. 99a Principles

1 SEM shall operate an information system for federal centres and airport accommodation (MIDES).

2 MIDES serves as an aid in:

a.
the processing of personal data relating to asylum seekers and persons in need of protection, including sensitive personal data and personality profiles in accordance with Article 3 letters c and d of the FADP302; and
b.
audits, the conduct of asylum procedures and the planning and organisation of accommodation.

3 MIDES contains the following personal data:

a.
data on the identity of the registered persons, and in particular their surname, name, sex, date and place of birth, nationality, ethnic origin, religion, marital status, address and parents' names;
b.303
minutes of the summary questioning conducted at federal centres and at the airports in accordance with Articles 22 paragraph 1 and 26 paragraph 3;
c.
biometric data;
d.
details of the accommodation;
e.
the status of the proceedings;
f.304
the note «medical case», for the purpose of distributing asylum seekers among the cantons.

4 The personal data in accordance with paragraph 3 letters a, c, e and f shall be entered in ZEMIS.305

5 The asylum seekers and persons in need of protection must in particular be informed of the reasons for processing the data and the categories of data recipient.

Art. 99a Grundsätze

1 Das SEM führt ein Informationssystem der Zentren des Bundes und der Unterkünfte an den Flughäfen (MIDES).

2 MIDES dient:

a.
der Bearbeitung von Personendaten von Asylsuchenden und Schutzbedürftigen, einschliesslich der besonders schützenswerten Personendaten und der Persönlichkeitsprofile nach Artikel 3 Buchstaben c und d DSG302; und
b.
der Geschäftskontrolle, der Durchführung des Asylverfahrens sowie der Planung und Organisation der Unterbringung.

3 MIDES enthält folgende Personendaten:

a.
Daten zur Identität der registrierten Personen, nämlich Name, Vorname, Geschlecht, Geburtsdatum und -ort, Nationalität, Ethnie, Religion, Zivilstand, Adresse und Namen der Eltern;
b.303
Protokolle der in den Zentren des Bundes und an den Flughäfen durchgeführten summarischen Befragungen nach den Artikeln 22 Absatz 1 und 26 Absatz 3;
c.
biometrische Daten;
d.
Angaben über die Unterbringung;
e.
den Stand des Verfahrens;
f.304
den Vermerk «Medizinalfall», um die Asylsuchenden auf die Kantone zu verteilen.

4 Die Personendaten nach Absatz 3 Buchstaben a, c, e und f werden ins ZEMIS übernommen.305

5 Die Asylsuchenden und die Schutzbedürftigen sind insbesondere über den Zweck der Datenbearbeitung und die Kategorien der Datenempfänger zu informieren.
