Art. 71 Granting temporary protection to families

1 Spouses of persons in need of protection and their minor children shall be granted temporary protection if:183

a.
they apply for protection together and there are no grounds for rejection in terms of Article 73;
b.
the family was separated by events such as those cited in Article 4, wishes to be reunited in Switzerland and there are no special circumstances that preclude this.

1bis If, during the procedure to grant temporary protection, SEM has reason to believe that there are grounds under Article 105 number 5 or 6 CC184 for the marriage to be annulled, they shall report this to the competent authority under Article 106 CC. The request for reunification shall be suspended until this authority makes its decision. If the authority raises an action for annulment, the request is suspended until a legally binding judgment has been issued.185

2 Children born in Switzerland to persons in need of protection shall also be granted temporary protection.

3 If the persons entitled to protection are abroad, their entry must be authorised.

4 The Federal Council shall regulate the requirements for family reunion in Switzerland in other cases.

Art. 71 Gewährung vorübergehenden Schutzes an Familien

1 Ehegatten von Schutzbedürftigen und ihren minderjährigen Kindern wird vorübergehend Schutz gewährt, wenn:183

a.
sie gemeinsam um Schutz nachsuchen und keine Ausschlussgründe nach Artikel 73 vorliegen;
b.
die Familie durch Ereignisse nach Artikel 4 getrennt wurde, sich in der Schweiz vereinigen will und keine besonderen Umstände dagegen sprechen.

1bis Hat das SEM während des Verfahrens zur vorübergehenden Schutzgewährung Anhaltspunkte dafür, dass ein Ungültigkeitsgrund nach Artikel 105 Ziffer 5 oder 6 ZGB184 vorliegt, so meldet es dies der nach Artikel 106 ZGB zuständigen Behörde. Das Gesuch um Nachzug wird bis zur Entscheidung dieser Behörde sistiert. Erhebt die Behörde Klage, so wird das Gesuch bis zum Vorliegen des rechtskräftigen Urteils sistiert.185

2 Den in der Schweiz geborenen Kindern von Schutzbedürftigen wird ebenfalls vorübergehender Schutz gewährt.

3 Befinden sich die anspruchsberechtigten Personen im Ausland, so ist ihre Einreise zu bewilligen.

4 Der Bundesrat regelt für weitere Fälle die Voraussetzungen für eine Vereinigung der Familie in der Schweiz.
