Art. 109i Third parties delegated tasks

1 SEM and the cantonal authorities entrusted with carrying out the return procedure may in providing return assistance delegate specific tasks to the return counselling agencies (Art. 93 para. 1 let. a AsylA402) and international organisations (Art. 93 para. 3 AsylA). They may delegate tasks to other third parties in connection with organising the return under Article 71 letter b of this Act.

2 SEM may grant third parties that have been delegated tasks access to the data in the Information System that they require to fulfil their mandate:

a.
for tasks in connection with return assistance and counselling;
b.
for tasks related to preparing for departure at the airport;
c.
for assessing the fitness of the person concerned to travel and for deciding on any medical assistance required.

3 SEM shall ensure that the third parties comply with the regulations on data protection and on information technology security.

4 The Federal Council shall decide which categories personal data in the information system may be processed by the third parties that have been delegated tasks mentioned in paragraph 1 above.

Art. 109i Beauftragte Dritte

1 Das SEM und die kantonalen Behörden, die mit der Durchführung der Rückkehr betraut sind, können im Rahmen der Rückkehrhilfe bestimmte Aufgaben den Rückkehrberatungsstellen (Art. 93 Abs. 1 Bst. a AsylG402) sowie internationalen Organisationen (Art. 93 Abs. 3 AsylG) übertragen. Sie können im Bereich der Rückreiseorganisation nach Artikel 71 Buchstabe b dieses Gesetzes auch Aufgaben an weitere Dritte übertragen.

2 Das SEM kann beauftragten Dritten Zugriff auf die zur Erfüllung ihres Auftrags notwendigen Daten des Informationssystems gewähren:

a.
für die Aufgaben im Zusammenhang mit der Rückkehrhilfe und -beratung;
b.
für die Aufgaben zur Vorbereitung der Ausreise am Flughafen;
c.
für die Abklärung der Transportfähigkeit der betroffenen Person und die Bestimmung der medizinischen Begleitung.

3 Das SEM stellt sicher, dass die Dritten die Vorschriften zum Datenschutz und zur Informatiksicherheit einhalten.

4 Der Bundesrat legt fest, welche Kategorien von Personendaten die in Absatz 1 genannten beauftragten Dritten im Informationssystem bearbeiten dürfen.
