1 Where computer systems and computer networks located abroad are used to carry out attacks on critical infrastructures in Switzerland, the FIS may intrude into these computer systems and computer networks in order to disrupt, prevent or slow down access to information. The Federal Council shall decide on whether such a measure should be carried out.
2 The FIS may intrude into computer systems and computer networks abroad in order to gather information about events outside Switzerland that is available there or that has been transmitted from there. The Head of the DDPS shall decide after consulting the Head of the FDFA and the Head of the FDJP on whether such a measure should be carried out.
1 Werden Computersysteme und Computernetzwerke, die sich im Ausland befinden, für Angriffe auf kritische Infrastrukturen in der Schweiz verwendet, so kann der NDB in diese Computersysteme und Computernetzwerke eindringen, um den Zugang zu Informationen zu stören, zu verhindern oder zu verlangsamen. Der Bundesrat entscheidet über die Durchführung einer solchen Massnahme.
2 Der NDB kann in Computersysteme und Computernetzwerke im Ausland eindringen, um dort vorhandene oder von dort aus übermittelte Informationen über Vorgänge im Ausland zu beschaffen. Die Vorsteherin oder der Vorsteher des VBS entscheidet nach vorheriger Konsultation der Vorsteherin oder des Vorstehers des EDA und der Vorsteherin oder des Vorstehers des EJPD über die Durchführung einer solchen Massnahme.
