1 Genügt eine Finanzmarktinfrastruktur den besonderen Anforderungen dieses Kapitels nicht, so richtet die Nationalbank eine Empfehlung an den Betreiber.
2 Sie erlässt eine Verfügung, wenn der Betreiber eine entsprechende Empfehlung nach Absatz 1 nicht befolgt.
3 Sie gibt dem Betreiber jeweils Gelegenheit zur Stellungnahme, bevor sie eine Empfehlung nach Absatz 1 an den Betreiber richtet oder eine Verfügung nach Absatz 2 erlässt. Untersteht die Finanzmarktinfrastruktur der Bewilligungspflicht und der Aufsicht durch die FINMA im Sinne von Artikel 4 FinfraG76, so hört sie vorgängig die FINMA an.

1 If a financial market infrastructure does not satisfy the special requirements specified in this chapter, the National Bank shall issue a recommendation to the operator.
2 The National Bank shall issue an order if the operator fails to comply with a corresponding recommendation as specified in paragraph 1.
3 Before issuing the recommendation specified in paragraph 1 or the order specified in paragraph 2, the National Bank shall provide the operator with the opportunity to express an opinion. If the financial market infrastructure is subject to authorisation and supervision by FINMA pursuant to Article 4 FinMIA76, the National Bank shall first consult FINMA.
