1 Die Kontrollämter haben die ihnen obliegenden Funktionen nach Massgabe der gesetzlichen Vorschriften und der ihnen durch das Zentralamt erteilten Weisungen auszuüben.
2 Sie besorgen die amtliche Prüfung und Stempelung der Edelmetallwaren (Art. 13–17 des Gesetzes) sowie die Feingehaltsbestimmungen von Schmelzgut und Schmelzprodukten, die ihnen durch private Auftraggeber übertragen werden (Art. 32 des Gesetzes). Schmelzungen auf fremde Rechnung dürfen nur gestützt auf eine besondere Ermächtigung des Eidgenössischen Finanzdepartementes vorgenommen werden.
3 Das Zentralamt kann den Kontrollämtern im Einzelfall die Vornahme von Untersuchungen und Feststellungen hinsichtlich vorgekommener Gesetzesverletzungen übertragen.
4 Nimmt das Kontrollamt von sich aus ein Vergehen oder eine Ordnungsverletzung wahr, so hat es die nötigen vorläufigen Feststellungen zu machen und hierauf das Zentralamt unter Einsendung der Akten zu benachrichtigen. Dieses bestimmt, welche weitern Massnahmen zu treffen sind.
1 The Assay Offices must perform their duties in accordance with the statutory provisions and the directives that they receive from the Central Office.
2 They shall take charge of the official controlling and hallmarking of precious metal articles (Art. 13–17 of the Act) and determination of the fineness of melt material and melt products submitted by private customers (Art. 32 of the Act). Melting on behalf of third parties is only permitted with the special authorisation of the Federal Department of Finance.
3 In particular cases, the Central Office may entrust the Assay Office with the performance of tests and analyses with regard to violations of the law.
4 If the Assay Office becomes aware of an offence or violation of its own accord, it must draw up the provisional findings required and then submit the file to the Central Office. The latter shall decide on any further measures to be taken.
