Art. 40a Massnahmen gegen Waldschäden ausserhalb des Schutzwaldes

(Art. 37a WaG)

1 Die Höhe der globalen Abgeltungen an Massnahmen zur Verhütung und Behebung von Waldschäden ausserhalb des Schutzwaldes, richtet sich nach:

a.
der Gefährdung der Waldfunktionen;
b.
der Anzahl Hektaren, auf denen Massnahmen ergriffen werden;
c.
der Qualität der Leistungserbringung.

2 Sie wird zwischen dem BAFU und dem betroffenen Kanton ausgehandelt.

3 Abgeltungen können einzeln gewährt werden, wenn die Massnahmen unvorhersehbar waren und besonders aufwendig sind. Der Beitrag beträgt höchstens 40 Prozent der Kosten und richtet sich nach Absatz 1 Buchstaben a und c.

Art. 40a Measures against forest damage outside the protective forest

(Art. 37a ForA)

1 The amount of global financial assistance for measures to prevent and mitigate forest damage outside the protective forest is determined by:

a.
the degree of threat to forest functions;
b.
the number of hectares over which measures are taken;
c.
the quality of the services.

2 The FOEN and the cantons concerned shall negotiate the amount.

3 Financial assistance may be awarded in individual cases in which the measures were unforeseeable and particularly costly. The amount shall not exceed 40 per cent of the costs and is determined in accordance with paragraph 1 letters a and c.
