818.102.2 Ordinance of 4 June 2021 on Certificates to Prove COVID-19 Vaccination, COVID-19 Recovery or a COVID-19 Test Result (COVID-19 Certificates Ordinance)

Art. 19 Voraussetzungen

1 Ein Covid-19-Testzertifikat wird ausgestellt bei einem negativen Ergebnis:

a.
einer molekularbiologischen Analyse auf Sars-CoV-2;
b.46
eines Sars-CoV-2-Schnelltests zur Fachanwendung nach Artikel 24a Absatz 1 der Covid-19-Verordnung 3 vom 19. Juni 202047, ausser er basiert auf einer Probeentnahme nur aus dem Nasenraum oder auf einer Speichelprobe;
c.48
einer laborbasierten immunologischen Analyse auf Sars-CoV-2-Antigene, sofern:
1.
die Analyse durch ein nach Artikel 16 des Epidemiengesetzes vom 28. September 201249 bewilligtes Laboratorium durchgeführt wurde,
2.
der Test in der EU für die Ausstellung eines digitalen COVID-Zertifikats der EU zugelassen ist,
3.
die Probe von einer Einrichtung nach Anhang 6 Ziffer 1.4.3 Buchstabe a der Covid-19-Verordnung 3 entnommen wurde, und
4.
der Test weder auf einer Probenentnahme nur aus dem Nasenraum noch auf einer Speichelprobe basiert.

1bis Das BAG führt eine aktualisierte Liste der Sars-CoV-2-Schnelltests nach Absatz 1 Buchstabe b und der laborbasierten immunologischen Analysen auf Sars-CoV-2-Antigene nach Absatz 1 Buchstabe c und veröffentlicht sie auf seiner Website.50

1ter In folgenden Fällen dürfen für Analysen auf Sars-CoV-2 keine Covid-19-Testzertifikate ausgestellt werden:

a.
bei Personen, die symptomatisch sind;
b.
bei Personen, die in einem der folgenden Zeiträume im selben Haushalt lebten oder in ähnlicher Weise regelmässigen und engen Kontakt hatten mit:
1.
einer Person, deren Ansteckung mit Sars-CoV-2 bestätigt oder wahrscheinlich ist und die symptomatisch ist: in den letzten 48 Stunden vor dem Auftreten der Symptome und bis 5 Tage danach,
2.
einer Person, deren Ansteckung mit Sars-CoV-2 bestätigt ist und die asymptomatisch ist: in den letzten 48 Stunden vor der Probenentnahme und bis zur Absonderung der Person;
c.
bei einer ärztlich angeordneten Ausbruchsuntersuchung und -kontrolle;
d.
bei Personen, die von der SwissCovid-App benachrichtigt werden, dass sie potenziell mit einer Person engen Kontakt hatten, die sich mit Sars-CoV-2 angesteckt hat;
e.
nach einem positiven Ergebnis bei einem Sars-CoV-2-Schnelltest zur Fachanwendung oder bei einem Sars-CoV-2-Selbsttest.51

2 Anträge auf Ausstellung von Testzertifikaten können spätestens anlässlich der Probeentnahme gestellt werden.

Art. 19 Requirements

1 A COVID-19 test certificate shall be issued in the event of a negative result of:

a.
a molecular-biological analysis for Sars-CoV-2;
b.46
a Sars-CoV-2 rapid test for specialist use in accordance with Article 24a of the COVID-19 Ordinance 3 of 19 June 202047, unless it is based on a sample taken only from the nasal cavity or on a saliva sample.
c.48
a laboratory immunological analysis for Sars-CoV-2 antigens, provided:
1.
the analysis was carried out by a laboratory licensed under Article 16 of the Epidemics Act of 28 September 201249,
2.
the test is authorised in the EU for issuing an EU digital COVID certificate,
3.
the sample was taken by a facility specified in Annex 6 number 1.4.3 letter a of the COVID-19 Ordinance 3, and
4.
the test is not based on a sample taken solely from the nasal cavity or on a saliva sample.

1bis The FOPH shall maintain an updated list of Sars-CoV-2 rapid tests in accordance with paragraph 1 letter b of laboratory immunological analyses for Sars-CoV-2 antigens in accordance with paragraph 1 letter c, and publish it on its website.50

1ter COVID-19 test certificates may not be issued for analyses for Sars-CoV-2 in the following cases:

a.
to persons who have symptoms;
b.
to persons who have in any of the following periods lived in the same household as or in a similar way have had close and regular contact with:
1.
a person whose infection with Sars-VoV-2 has been confirmed or is probable and who has symptoms: in the 48 hours prior to the appearance of symptoms and for 5 days thereafter,
2.
a person whose infection with Sars-VoV-2 has been confirmed but who is asymptomatic: in the 48 hours prior to the sample being taken and until the person went into isolation;
c.
in an outbreak investigation and control ordered by a doctor;
d.
to persons who have been notified by the SwissCOVID app that they have potentially had close contact with a person who has been infected with Sars-CoV-2;
e.
to persons who have tested positive in a Sars-CoV-2 rapid test for specialist use or in a Sars-CoV-2 self-test.51
