Art. 13 Emissionsmessungen und -kontrollen

¹ Die Behörde überwacht die Einhaltung der Emissionsbegrenzungen. Sie führt selber Emissionsmessungen oder -kontrollen durch oder lässt solche durchführen.

² Die erste Messung (Abnahmemessung) oder Kontrolle muss wenn möglich innert drei, spätestens jedoch innert zwölf Monaten nach der Inbetriebnahme der neuen oder sanierten Anlage erfolgen. Vorbehalten bleiben abweichende Bestimmungen in Anhang 3.⁹

³ In der Regel ist die Messung oder Kontrolle unter Vorbehalt abweichender Bestimmungen in den Anhängen 2, 3 und 4 wie folgt zu wiederholen:

a.: bei Heizkesseln für Holzbrennstoffe nach Anhang 5 Ziffer 31 Absatz 1 Buchstabe a, b oder d Ziffer 1 mit einer Feuerungswärmeleistung bis 70 kW und bei Gasfeuerungen mit einer Feuerungswärmeleistung bis 1 MW alle vier Jahre;
b.: bei den übrigen Feuerungsanlagen alle zwei Jahre;
c.¹⁰: bei den übrigen Anlagen alle drei Jahre.¹¹

⁴ Bei Anlagen, aus denen erhebliche Emissionen austreten können, ordnet die Behörde die kontinuierliche Messung und Aufzeichnung der Emissionen oder einer anderen Betriebsgrösse an, welche die Kontrolle der Emissionen ermöglicht.

Art. 13 Emission measurements and inspections

¹ The authorities shall monitor compliance with emission limitation requirements. They shall carry out their own emission measurements or inspections or shall have these carried out on their behalf.

² If possible, the first measurement (acceptance measurement) or inspection must be carried out within three months, but no later than twelve months after the commissioning of the new or retrofitted installation. The foregoing is without prejudice to different provisions in Annex 3.⁹

³ The measurement or inspection is generally to be repeated as follows, without prejudice to provisions to the contrary specified in Annexes 2, 3 and 4:

a.: every four years for wood-fired boilers as specified in Annex 5 Number 31 paragraph 1 letter a, b or d Number 1 with a rated thermal input of up to 70 kW and for gas-fired installations with a rated thermal input of up to 1 MW;
b.: every two years for other combustion installations
c.¹⁰: every three years for other installations.¹¹

⁴ In the case of installations which may produce significant levels of emissions, the authorities shall order continuous measurement and recording of emissions, or of another operating parameter which permits emission control.
