Art. 11d Biozidprodukte zur Verwendung durch die breite Öffentlichkeit

Ein Biozidprodukt wird für das Inverkehrbringen zur Verwendung durch die breite Öffentlichkeit nicht zugelassen, wenn es:

a.
Eigenschaften gemäss den Kriterien nach der EU-CLP-Verordnung84 aufweist und eine der folgenden Einstufungen aufweist:
1.
akute orale Toxizität der Kategorie 1, 2 oder 3,
2.
akute dermale Toxizität der Kategorie 1, 2 oder 3,
3.
akute inhalative Toxizität (Gas und Staub/Nebel) der Kategorie 1, 2
oder 3,
4.
akute inhalative Toxizität (Dampf) der Kategorie 1 oder 2,
5.
spezifische Zielorgan-Toxizität der Kategorie 1 bei einmaliger oder wiederholter Exposition,
6.
karzinogen der Kategorie 1A oder 1B,
7.
mutagen der Kategorie 1A oder 1B,
8.
reproduktionstoxisch der Kategorie 1A oder 1B;
b.
aus einem Stoff besteht, einen Stoff enthält oder einen Stoff erzeugt, der Eigenschaften gemäss den Kriterien «PBT» oder «vPvB» nach Anhang XIII der EU-REACH-Verordnung85 aufweist;
c.
endokrinschädigende Eigenschaften gemäss den Kriterien nach der delegierten Verordnung (EU) 2017/210086 festgelegten Kriterien aufweist; oder
d.
entwicklungsneurotoxische oder -immunotoxische Auswirkungen hat.

Art. 11d Biocidal products for use by the general public

A biocidal product shall not be authorised for placing on the market for use by the general public if:

a.
it has properties meeting the criteria specified in the CLP Regulation84 and is classified as:
1.
acute oral toxicity category 1, 2 or 3,
2.
acute dermal toxicity category 1, 2 or 3,
3.
acute inhalation toxicity (gases and dust/mist) category 1, 2 or 3,
4.
acute inhalation toxicity (vapours) category 1 or 2,
5.
specific target organ toxicity by single or repeated exposure category 1,
6.
a category 1A or 1B carcinogen,
7.
a category 1A or 1B mutagen, or
8.
toxic for reproduction category 1A or 1B;
b.
it consists of, contains or generates a substance with properties meeting the criteria for being PBT or vPvB in accordance with Annex XIII to the REACH Regulation85;
c.
it has endocrine-disrupting properties meeting the criteria specified in Delegated Regulation (EU) 2017/210086; or
d.
it has developmental neurotoxic or immunotoxic effects.
